Summary
Mercedes-Benz
USA, LLC (MBUSA) is recalling certain 2023 EQE 350, S580e, 2022-2023 EQS 450, EQS 580, 2022 AMG EQS 53, and EQS 450+ vehicles. The high-voltage battery monitoring system software may not alert the driver of a battery malfunction. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 305, “Electric-powered vehicles: Electrolyte Spillage and Electrical Shock Protection.”
Remedy
Dealers will update the battery management system software, free of charge. Owner notification letters were mailed August 18, 2023. Owners may contact MBUSA customer service at 1-800-367-6372. MBUSA’s number for this recall is 2023070013.

This is to notify you of the Recall Campaign Launch to update the Battery Management System software on 3,679 Model Year (“MY”) 2022-2023 S-Class, EQE, EQS SUV, and EQS (223, 295, 296, and 297 platform) vehicles. The recall campaign will be visible on the www.NHTSA.gov website and may generate questions from customers. Affected VINs will be flagged in VMI as “OPEN” on July 28, 2023.

AG (“MBAG”), the manufacturer of Mercedes-Benz
vehicles, has determined that on certain Model Year (“MY”) 2022-2023 S-Class, EQE, EQS SUV, and EQS (223, 295, 296, and 297 platform) vehicles, the monitoring function of the high-voltage battery might be impaired over time. In certain circumstances, a warning alerting the driver of a battery malfunction might not activate in the event of a fault. In such instances, the warning would not comply with a requirement of FMVSS 305 (Electric-powered vehicles).
What We’re Doing
MBUSA will conduct a voluntary recall. An authorized Mercedes-Benz
dealer will update the software for the Battery Management System on the affected vehicles.
Parts
The remedy is available and can be performed.
Given this notice, it is a violation of Federal law for a dealer to sell or lease any new vehicles in dealer inventory covered by this notification until the vehicle has been repaired. Once the remedy is available, the vehicles will be flagged as “OPEN” and Work Instructions will be available in NetStar VMI and Xentry Portal. Once the repair is complete the vehicle may be sold or leased.
Loaner and demonstrator vehicles may continue to be driven, but must not be retailed until repaired. As a matter of normal service process, please check for other repair measures which might be applicable to the vehicle(s).
Additionally, given this notice, it is a violation of Federal Law for car rental companies to rent new vehicles covered by this notification until the vehicle has been repaired.
Update Battery Management System Software
- Always use the latest XENTRY Diagnosis software release with all available add-ons.
- Follow the operation steps exactly as described in XENTRY Diagnosis.
- Use a charger to ensure sufficient power supply to the vehicle’s on-board electrical battery system (greater than 12.5 V).
- If XENTRY Diagnosis is already connected to the vehicle, start with Work Procedure step 2.
If two or more software updates or SCN codings are performed during a single workshop visit, operation items 02-4762 and 02-5058 may be invoiced only on one of the workshop orders.
Work Procedure
- Connect XENTRY Diagnosis.
- Update battery management system control unit software.
To do this, select menu item “Quick test view → N82/2 battery management system (BMS) → Adaptations → Control unit update → Update of control unit software”.
Then follow the user guidance in XENTRY Diagnosis.
- Disconnect XENTRY Diagnosis.

The additional VINs were flagged in VMI as “OPEN” on September 14, 2023.

Interim customer letters were mailed on June 16, 2023.
Wave 1: Final customer letters were mailed on August 18, 2023.
Amendment: Final customer letters will be mailed on or before September 29, 2023.
Final customer letters will be mailed approximately 2-3 weeks after the launch of each wave.

Chronology :
In May 2022, MBAG examined an abnormality identified during battery and software testing. Internal tests indicated a potential deviation from specifications. MBAG’s further investigation determined that in some vehicles, the Battery Management System (BMS) might experience a fault that could affect certain diagnostic functions.
MBAG initiated a review of whether the identified potential fault might have regulatory compliance implications in any of the jurisdictions in which the potentially affected vehicles were sold.
From December 2022 through March 2023, MBAG continued to investigate possible effects of the potential BMS diagnostic fault. This continued investigation identified a potential failure of a warning indicator to alert the driver of a BMS malfunction.
On April 21, 2023, MBAG determined that non-compliance with FMVSS 305 cannot be ruled out and decided to conduct a recall.
September 19, 2023:
On September 12, MBAG ran a new search to identify vehicle allocation for markets outside of the USA. It was noted that 5 vehicles previously located in foreign markets were now in the US market. As a result, the additional vehicles were added to recall 23V309.
MBAG is not aware of any warranty claims, field or service reports, or reports of property damage, death, or injury related to this defect.

In order to use the J2534 complaint software for Mercedes-Benz
vehicles, the purchaser must furnish their own:

Vehicle Coverage
J2534 complaint software for Mercedes-Benz
vehicles has coverage for all required functions associated to reprogramming, initialization, and fault clearing of emission control modules (engine and transmission) fitted to vehicles 2004 Model Year and newer. Additionally all access and functionality required in regard the configuration via SCN Coding and/or CVN Coding is covered.
J2534 complaint software for Mercedes-Benz
vehicles is delivered via DVD media which is delivered monthly for the license term of one year upon purchase.
- All control unit software (reprogramming calibrations) is contained within J2534 DVD media.
Terms and conditions
J2534 complaint software for Mercedes-Benz
vehicles is purchased in 1-year license increments. During that license term the user will receive an initial software package, license key, SCN/CVN Coding information/access as well as monthly updates via DVD media.
- Additional updates of software after the 1st year can be purchased at additional cost, however are not required for the system to continue functioning.

Internal tests indicated a potential deviation from specifications. MBAG’s further investigation determined that in some vehicles, the Battery Management System (BMS) might experience a fault that could affect certain diagnostic functions. MBAG initiated a review of whether the identified potential fault might have regulatory compliance implications in any of the jurisdictions in which the potentially affected vehicles were sold. From December 2022 through March 2023, MBAG continued to investigate possible effects of the potential BMS diagnostic fault. This continued investigation identified a potential failure of a warning indicator to alert the driver of a BMS malfunction. On April 21, 2023, MBAG determined that non-compliance with FMVSS 305 cannot be ruled out and decided to conduct a recall. MBAG is not aware of any warranty claims, field or service reports, or reports of property damage, death, or injury related to this defect. In certain circumstances, a warning alerting the driver of a battery malfunction might not activate in the event of a fault. Internal tests indicated a potential deviation from specifications. MBAG’s further investigation determined that in some vehicles, the Battery Management System (BMS) might experience a fault that could affect certain diagnostic functions. MBAG initiated a review of whether the identified potential fault might have regulatory compliance implications in any of the jurisdictions in which the potentially affected vehicles were sold. From December 2022 through March 2023, MBAG continued to investigate possible effects of the potential BMS diagnostic fault. This continued investigation identified a potential failure of a warning indicator to alert the driver of a BMS malfunction. On April 21, 2023, MBAG determined that non-compliance with FMVSS 305 cannot be ruled out and decided to conduct a recall. September 19, 2023: On September 12, MBAG ran a new search to identify vehicle allocation for markets outside of the USA. It was noted that 5 vehicles previously located in foreign markets were now in the US market. As a result, the additional vehicles were added to recall 23V309. MBAG is not aware of any warranty claims, field or service reports, or reports of property damage, death, or injury related to this defect.
